Estate Planning Trends

WealthCounsel, in conjunction with Trusts & Estates magazine and Informa Engage, surveyed almost 400 estate planning professionals in the second quarter of 2023. The survey addressed preferred methods of drafting trusts, the sunset of the estate tax exemption amount, and attitudes toward emerging technologies such as generative artificial intelligence (AI). It also discussed attorneys’ job satisfaction and referral sources (incoming and outgoing). 145 survey respondents reported working for a law practice. The analyses in the following pages are based on those 145 respondents.

This year’s Industry Trends survey results show that estate planning attorneys employ a variety of trust options to serve their clients. Respondents most commonly draft revocable living trusts, irrevocable life insurance trusts, and qualified terminable interest property trusts. Almost one-quarter of respondents regularly incorporate trust protector provisions.
